Welcome to NutrScan. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Promakes LLC ("Company," "we," "our," or "us"), governing your access to and use of the NutrScan mobile application, website, and related cloud backend services (collectively, the "Service").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Medical and Health Disclaimer (Crucial)
NutrScan is NOT a Medical Tool. The Service is designed for informational, educational, and reference purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
Crowdsourcing Data Risks: The product ingredients and nutritional information displayed in the app are exact replicas of raw data retrieved from crowdsourced data, primarily Open Food Facts. We do not alter, modify, or verify the accuracy of this raw data. Because crowdsourced data is generated by the public, it can be incomplete, outdated, or erroneous. We strictly disclaim any liability for its accuracy.
Allergies & Health Conditions: You must always read the physical label on the product packaging before consumption, especially if you have food allergies, intolerances, or specific medical conditions.
Scientific Scoring System: To calculate the danger or benefit score of additives and ingredients, our backend relies on our own proprietary, independent scientific database. While this database is built on established research, it reflects general nutritional assessments and not personalized medical guidance.
No Liability: Promakes LLC expressly disclaims any liability for adverse health reactions, allergic responses, or any damages resulting from your reliance on the information provided by the Service.
2. Scientific Scoring System and Proprietary Database
NutrScan features a proprietary evaluation system (the "Scoring System") that assesses the safety, benefits, and potential risks of food additives, ingredients, and allergens. You must understand how this system operates and its limitations:
A. Authoritative Data Sources
Our Scoring System does not invent safety data. It relies on toxicological, nutritional, and chemical assessments strictly derived from recognized global health, food safety, and regulatory authorities. These authoritative sources include, but are not limited to:
For Food & Contaminants: The European Food Safety Authority (EFSA), the U.S. Food and Drug Administration (FDA), the World Health Organization (WHO), the International Agency for Research on Cancer (IARC), and the Joint FAO/WHO Expert Committee on Food Additives (JECFA).
For Cosmetics & Packaging Chemicals: The Scientific Committee on Consumer Safety (SCCS), the Cosmetic Ingredient Review (CIR), and the European Chemicals Agency (ECHA).
For Allergens & Cross-Reactivity: The International Fragrance Association (IFRA), SCCS, and established peer-reviewed clinical studies.
B. The Role of Artificial Intelligence
To process and structure this vast amount of scientific data, our backend utilizes advanced Artificial Intelligence (AI) models.
The AI is strictly instructed to operate as an expert toxicologist and allergist. It generates safety summaries (such as ADI, TDI, carcinogenicity, and mutagenicity) and assigns penalty or bonus scores based only on the consensus of the aforementioned scientific agencies.
The AI is explicitly programmed not to hallucinate or invent scientific references or regulatory guidelines.
C. Specific Medical and Liability Disclaimer
Despite relying on these highly respected scientific bodies, the Scoring System is a general nutritional guide and not a diagnostic tool.
Scientific Evolution: Scientific consensus evolves continuously. A substance deemed safe today by the FDA or EFSA may be reclassified tomorrow. We do not guarantee that our local database reflects real-time updates from these agencies.
No Personalized Advice: The penalty or bonus scores assigned to ingredients are generalized. They do not take into account your personal health history, pre-existing conditions, specific sensitivities, or cumulative dietary intake.
Allergen Alerts: While our system categorizes and flags potential food and fragrance allergens (including cross-reactivities based on clinical data), it cannot guarantee a product is 100% safe for you. Manufacturers often change their formulas without notice, or cross-contamination can occur during manufacturing.
Total Exoneration: Promakes LLC assumes absolutely no liability for any allergic reactions, illness, distress, or medical emergencies that may occur from consuming a product, regardless of the safety score or allergen alerts generated by our AI and Proprietary Database.
3. Data Sources, AI, and System Security
Open Database License (ODbL): The raw product catalog data is sourced from Open Food Facts and is provided under the Open Database License (ODbL). NutrScan acts as a mirror/client for this data.
Use of AI: We utilize advanced Artificial Intelligence models in our backend infrastructure strictly to summarize, translate, and explain the raw nutritional data in plain language. The AI does not invent, modify, or tamper with the core nutritional values or ingredient lists.
System Security: Attempting to hack, exploit, bypass, or forcefully inspect the underlying backend infrastructure, databases, or cloud servers of NutrScan is strictly prohibited and is a direct violation of these Terms.
4. Subscriptions, Billing, and Cancellation
NutrScan operates on a freemium model. Premium features (such as the Offline Database and unlimited scanning) require a paid subscription.
Payment Processing: All purchases, subscriptions, and auto-renewals are handled securely and exclusively by the respective app stores (Apple App Store and Google Play Store). We do not process or store your payment information on our servers.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Cancellation & Refunds: You must manage or cancel your subscription directly through your Apple ID or Google Play account settings. NutrScan (Promakes LLC) cannot issue direct refunds. All refund requests are subject to the policies of Apple and Google.
5. Accounts, Guest Mode, and Data Responsibility
Registered Accounts: If you create an account, your scan history and favorites are synchronized securely with our cloud database. You are responsible for maintaining the confidentiality of your login credentials.
Guest Mode: You may use the app without an account ("Guest Mode"). In this mode, all your data (scan history, favorites) is stored locally on your device only. It is not backed up on our servers. If you lose your device, clear the app data, or uninstall the app, your Guest Mode data will be permanently lost, and we cannot recover it. We bear no liability for such data loss.
6. Intellectual Property and Proprietary Databases
All rights, titles, and interests in the Service (excluding the ODbL-licensed raw data) are the exclusive property of Promakes LLC. This includes the application source code, UI/UX design, logos, and our proprietary structured databases.
The Offline Database: Our premium offline database, which includes our proprietary scientific safety scoring engine and localized catalog bundles, is a highly protected intellectual property asset.
Strict Prohibition on Reverse Engineering: You are strictly prohibited from decompiling, reverse engineering, scraping, or attempting to extract the underlying local databases (SQLite), algorithms, or source code from the mobile application. Any unauthorized extraction or commercial use of our structured databases will result in immediate legal action and account termination.
7. Acceptable Use Policy
You agree not to misuse the Service. Specifically, you must not:
Perform automated, repetitive, or "spam" scanning to exhaust our server limits or API quotas.
Attempt to bypass our freemium limits, ad-gates, or subscription checks.
Use the Service to build a competitive product.
We reserve the right to suspend or permanently ban any IP address, device, or account that violates these rules, without prior notice or refund.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Promakes LLC and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to:
Financial or moral losses.
Damages resulting from app downtime, server outages, or synchronization failures.
Data loss (including local device data or cloud backups).
Physical harm, allergic reactions, or health issues arising from the use of the app's nutritional information.
Under no circumstances will Promakes LLC provide any financial compensation or refunds for damages or losses arising from your use of the Service.
9. Changes to Terms and Pricing
We reserve the right to modify these Terms, as well as the pricing of our Premium subscriptions, at any time.
Changes will become effective immediately upon posting the updated Terms on this page, with the "Last Updated" date revised accordingly.
Continued use of the Service after changes are published constitutes your acceptance of the new Terms.
